Journal Article 2021 05 29   In spite of the considerable development of international space law, national policy and law is currently the strongest and most effective source for the leading governments’ programs and activities governance. Despite pioneering space activities and significant space programs, the Soviet Union lacked clear legislative mechanisms in the field of space law. However, the Soviet Union collapse highlighted the need to found legal and organizational foundations for space activities in Russia.<br />             This article has been written with the aim of recognizing the phenomenon of national space legislation in the Russian Federation and specifically seeks to find an appropriate answer to the question “what are the main motives of the Russian Federation to develop national legal rules in the field of space? The initial response, based on the research literature isthat "the development of national space law in the Russian Federation enormously reflects Moscow's four main motives including protecting national space sovereignty, filling in the gaps in the international treaty system in the field of space, influencing international norms governing space, as well as strengthening the rules for using the left-over bases and space facilities in post-Soviet lands. "The findings of the article confirm the validity of the hypothesis. The present article belongs to the post-event classification and to test the hypothesis, inferential methodology based on logical reasoning has been used. <em>با وجود پیشرفت قابل‏ توجه حقوق بین ‏الملل فضا، قوی‏ترین و مؤثرترین منبع ‏حکمرانی فعالیت‏ ها و برنامه‏ های فضایی دولت‏ های پیشرو در این حوزه را در حال حاضر خط‏ مشی‏ ها و حقوق ملی فضا تشکیل می ‏دهد. اتحاد جماهیر شوروی به ‏رغم پیشگامی در فعالیت ‏های فضایی و برخورداری از برنامه ‏های فضایی چشم‏گیر، فاقد سازوکارهای مشخص قانون‏گذاری در حوزه تدوین حقوق فضا بود، اما فروپاشی اتحاد جماهیر شوروی، ضرورت پی‏ریزی مبانی قانونی و سازمانی فعالیت ‏های فضایی در روسیه را برجسته ساخت. مقاله حاضر با هدف شناخت پدیده قانون‏گذاری ملی فضا در فدراسیون روسیه به نگارش درآمده است و به ‏طور مشخص ‏به ‏دنبال یافتن پاسخی مناسب برای این پرسش است که «انگیزه‏ های اصلی فدراسیون روسیه از توسعه قواعد حقوقی ملی در ‏حوزه فضا کدام‏ هستند؟» پاسخ اولیه مقاله برپایه ادبیات پژوهش این بوده است که «توسعه حقوق ملی فضا در ‏فدراسیون روسیه تا حد زیادی بازتاب ‏دهنده چهار انگیزه اصلی مسکو مبنی بر صیانت از حکمرانی ملی فضا، پرکردن ‏کاستی‏ های نظام بین ‏المللی معاهده ‏ای در حوزه فضا، تأثیرگذاری بر هنجارهای بین‏ المللی حاکم بر فضا و نیز تحکیم مقررات ‏استفاده از پایگاه ‏ها و تأسیسات فضایی به‏ جامانده در سرزمین ‏های پساشوروی است». یافته ‏های مقاله بر درستی این فرضیه صحه می‏ گذارند.‏ روش پژوهش در مقاله حاضر از نوع کیفی بوده و در طبقه‏ بندی مطالعات پس ‏‏رویدادی جای می ‏گیرد و آزمون فرضیه برپایه‏ ‏‏استدلال قیاسی صورت پذیرفته ‏است.‏</em> https://ca.ipisjournals.ir/article_244163_78213ac6bcf461de6d5c15ff9e87ff17.pdf
